Windfall challenge

The high court is currently hearing a challenge from Needler Financial Services and Collegiate Insurance to the 1997 decision of the Personal Investments Authority (PIA) that demutualisation windfalls should not be deducted from compensation for misselling of financial products. At issue are around 43,000 cases where a change to the PIA’s ruling could lead to attempted clawback.
