Knight v Black and Others – Supreme Ct of British Columbia (Ahmad J) 2021 BCSC 19 – 7 January 2021

Limitation of liability – Boat passenger injured in collision with sandbar – Whether defendants entitled to limit liability – Athens Convention 1974

The plaintiff was injured when the boat on which she was travelling collided with a sandbar on the Lillooet River near Pemberton, British Columbia. The issue was whether the defendants’ liability was limited by Part 4 of the Marine Liability Act, SC 2001, c 6 (the Act), which incorporated the limitation of liability in the Athens Convention 1974 relating to the carriage of passengers and their luggage by sea.
