Orient Overseas Container Line Ltd v ANL Singapore Pte Ltd and Others (The “APL England”) – Federal Ct (Stewart J) [2020] FCA 921 – 30 June 2020

Admiralty practice – Interlocutory relief – Cargo claim – Plaintiff cargo interests applying for orders allowing nominated marine surveyor to be given access to vessel to investigate circumstances of cargo loss and for defendants to give all reasonable assistance to such surveyor – Whether plaintiff entitled to relief sought.

The plaintiff cargo interests brought proceedings against the defendants following an incident wherein the third defendant’s vessel APL England lost propulsion in heavy seas, as a result of which the vessel pitched and rolled heavily, causing the collapse of one or more container stacks on deck.
