Alterations – Absolute covenant – Landlord’s obligations – Can landlord grant a consent?

We mention this case in brief to raise awareness for two reasons. First, the lead judgment is given by Lewison LJ, so always noteworthy, and secondly although it concerns a lease in a development of flats it may have some implications for the approach to adopt in leases of commercial premises.
