The ABC of internal investigations from the XYZ DPA

The United Kingdom’s Serious Fraud Office successfully defended a judicial review of its decision not to demand full interview notes from a corporate that entered into a deferred prosecution agreement – yet the SFO was upbraided by the judge for “material” public law errors. This is the first case of judicial scrutiny of the processes leading to a DPA from the perspective of an individual who is not party to it, comments Jessica Parker.
