Insurance (motor) - Road Traffic Act 1988, sections 151 and 152

C was injured when he was pushed by D's Ford Focus into the path of a Mercedes driven by an unidentified driver, and then run over by D's Ford Focus. The insurers of the Mercedes were identified, and they obtained a declaration under section 152 of the Road Traffic Act 1988 that they were entitled to avoid the policy for material non-disclosure. The question in the present proceedings was whether C could commence proceedings against the unidentified driver.
