Insurance (legal expenses) - Recovery of premiums from proceeds of judgment - Whether insurers entitled to lien for premiums
Successful proceedings were brought by Harlequin against WK in respect of investments in a construction project in the Caribbean, and some £7.9 million was recovered. The proceedings were funded by legal expenses insurance issued by two insurers, and a financial guarantee policy issued by a third insurer. Premiums totalling £3,020,600 were incurred. Harlequin was in liquidation. The insurers claimed a lien over the recovered sums in respect of unpaid premium.
