Practice – Set-off – Claim for air freight – Whether common law rule applied to preclude set-off against air freight

The claimant specialised in the transport of goods by road, rail, air and sea and the defendant sold, inter alia, raw materials. In October 2015 the parties entered into a contract for the transportation of chia seeds by air. The claimant sought to recover the freight due in the amount of some US$58,000.
