Star Polaris LLC v HHIC-Phil Inc (The “Star Polaris”) – QBD (Comm Ct) (Sir Jeremy Cook sitting as a Judge of the High Court) [2016] EWHC 2941 (Comm) – 17 November 2016

Contract – Shipbuilding contract – Builder guaranteeing defects for period of 12 months after delivery – Contract excluding liability for consequential losses – Vessel suffering serious engine failure – Whether buyer entitled to recover for diminution in value of vessel

The vessel Star Polaris was built by the defendant under a contract dated 6 April 2010 and delivered to the claimant buyer on 14 November 2011. On 29 June 2012 the vessel suffered a serious engine failure. On 2 September 2012 the vessel was towed to STX Gosung in South Korea for repairs.
