Charterparty – NYPE Inter-Club Agreement – Cargo damage – Shipowners incurring costs in defending proceedings brought by cargo receivers in foreign court – Whether shipowners entitled to indemnity from charterers

The subject vessel was chartered by the claimant owners (owners) to the respondent charterers (charterers) on an amended NYPE 1993 form. The charter provided that cargo claims as between the owners and the charterers should be settled in accordance with the Inter-Club NYPE Agreement 1996 (the ICA).
