His Honour Judge Gibbs QC handed down his decision in Baghbadrani v Commercial Union Assurance Co plc in February 1999. This decision is to be reported in a forthcoming issue of Lloyd’s Rep IR, and raises interesting and important questions concerning fraudulent claims and the possible loss of rights by an insurer “when faced with such a claim. Insurance Law Monthly is grateful to Davies Arnold Cooper for a transcript of the decision. The judgment is extremely lengthy and much of it is concerned with issues of fact.
