ORSA believes that the relationship between solicitors and expert witnesses is of the utmost importance in view of the duties of both to the court or other tribunal. This protocol has been prepared with a view to assisting clarity of communication and to provide a framework against which solicitors and experts are able to operate freely. It is not intended that this protocol should operate in a rigid way but that reference to it will enable experts and solicitors to consider key areas at an early date. ORSA is consulting widely on this document and welcomes comment. Details of how to respond are set out after the Protocol.
