Construction Industry Law Letter

SOCIETY OF CONSTRUCTION LAW

The Society of Construction Law has commended John McGuiness for his Hudson Prize paper, An Alternative Approach to Sub-Contract Arrangements following Pigott v Shepherd. In this paper, Mr McGuiness characterises Pigott v Shepherd as permitting sub-contractors to organise their works as they please, such that current forms of sub-contract are substantially unsuitable. He makes suggestions as to how the forms could be drafted, suggesting that Contracts of Employment may represent a better starting point for the drafting of sub-contracts than main contract forms.
