Adjudication - Whether adjudicator exceeded his jurisdiction or was alleged to have made a substantive error within that jurisdiction

The claimant referred a dispute with the defendant to adjudication and the adjudicator issued a decision in the claimant's favour which directed the defendant to pay £258,760.67 plus VAT. The defendant did not do so. The claimant brought an action for summary judgment to enforce the award. The defendant resisted enforcement on the ground that the adjudicator had failed to identify the contractual basis for the conclusion that the Scheme for Construction Contracts (England and Wales) Regulations 1998 ("the Scheme") was applicable.
