Last year, the Hong Kong Court of First Instance took the first opportunity among common law jurisdictions to express its view as to who is legally “in control of” a ship under section 12B(4) of the High Court Ordinance (HCO) (which is identical to section 21(4) of the Senior Courts Act 1981 (SCA 1981).
