Alterations – requirement to reinstate – written or oral notice

L Batley Pet Products Ltd v North Lanarkshire Council [2012] CSIH 83 A229/10 (Inner House, Court of Session) (7 November 2012)

This Scottish, Inner House Court of Session appeal decision raised an interesting point on the means of by which the landlord was to give notice to a tenant requiring reinstatement works to be carried prior to termination of the tenancy. The landlord Council gave an oral notice requiring reinstatement and the question for the court was whether this was sufficient to trigger the liability.
