INCORPORATING THE CHARTERPARTY’S APPLICABLE LAW CLAUSE INTO BILLS OF LADING

The terms and conditions of a charterparty may be incorporated into bills of lading issued under the charterparty. While general words of incorporation are not effective to incorporate an arbitration or jurisdiction clause at common law,1 it is not entirely clear whether an applicable law clause can be incorporated by general words of incorporation.
