40.1 In this chapter we consider what remedies may be awarded by the English courts in a dispute within the reinsurance market. Since a reinsurance policy is a contract the general contractual remedies provided by English law are applicable to reinsurance. Our examination of the remedies available to the parties to a reinsurance contract starts with a brief summary of these general remedies and we then consider the application of these remedies to reinsurance disputes.
