The law governing rights and obligations under contracts of reinsurance is not as well developed in the United States as one might expect for a commercial field as long-standing and widespread as the reinsurance industry. Indeed, New York, Massachusetts, Illinois, and California are only a few of the states whose case law can be said to have addressed major issues arising in the context of reinsurance disputes. In many other states, there is little more than a handful of reinsurance cases on the books.
