48.1 Effective litigation management is the key to resolving reinsurance disputes in a timely and cost-effective manner. Furthermore, if it appears that a dispute may result in litigation, a party can substantially improve its position by giving early and considered thought to how the litigation may be managed most effectively. Although this chapter cannot deal fully with the myriad of tactical and strategic issues which can potentially arise in litigation, particularly litigation involving larger sums, multiple parties or complex issues, it can highlight some of the key issues which will almost always have a significant bearing on the ultimate outcome.
