Solicitors’ negligence – service of a s25 notice opposing renewal on ground (f) and assessment of damages

Talisman Property Co (UK) Ltd v Norton Rose (a firm) Chancery Division, 18 November 2005 (unreported)

This case follows on from our report of the same in May 2005 (19 Commercial Leases 989) where the Court dealt with the liability of the defendant (NR) in serving a notice under s25 of the Act stating opposition on ground (f), contrary to instructions. The Court found in favour of the landlord and refused NR’s application for the claim to be dismissed summarily. The claim went forward for the determination of the substantive issues.
