M’Bundis v. Waratah Towage Pty Limited - Supreme Court of New South Wales (Waddell C.J. in Eq) - 7 September 1992

Towage - Injury to deck hand - United Kingdom standard conditions for towage and other services (revised 1974)

The plaintiff was employed as a deck hand on the tug boat Warringa which was owned by the defendant, Waratah Towage. On 4 July 1984 whilst the tug boat was engaged in assisting the vessel Canberra Maru , the plaintiff was injured when he slipped over on the deck of the tug boat. At the time of the plaintiff’s injury, it was raining and the sea was rough. The plaintiff was injured again while working on the tug boat on 17 January, 1985 and brought proceedings against the defendant claiming damages in respect of both injuries.
