N.P.L. (Australia) Pty Ltd. v. Kamil Export (Australia) Pty Limited - Supreme Court of Victoria (Hayne J.) - 12 October 1992

Carriage of goods - Delivery without bills of lading - Exclusion clause

Kamil Export Pty Ltd. carried on business exporting goods from Australia. In 1985 it shipped some goods to Guam on the General Valdez . The goods were delivered to the consignee without production of the bills of lading and without paying for the goods. In 1987 it shipped some goods to Nauru and again the consignee obtained possession of the goods without producing the bills of lading and without paying from them.
