Whether cargo owners’ action time-barred - Construction of Admiralty Jurisdiction Regulation Act 105 of 1983

The plaintiff cargo interests were holders of a bill of lading which incorporated the Hague Rules, Article III Rule 6 of which provided that the carrier and the ship should be discharged from all liability in respect of loss or damage unless suit was brought within one year after delivery of the goods or the date when the goods should have been delivered.
