Sembawang Reefer Lines (Bahamas) Ltd. v. The Ship Lina Erre and others - Fed.Ct. (Trial Div.) (Dube J.) - 29 June 1989

Conflict of laws - Whether maritime lien extinguished

A collision involving the vessel Lina Erre (then named Pacos ) occurred in the harbour of Piraeus on 11 January 1987. At that time the vessel was registered in Panama. On 28 January 1987 the ownership of the vessel changed and the transfer was registered in Italy. The vessel was arrested in Montreal on 13 December 1988 by the plaintiff, owner of the vessel Reefer Manggis damaged in the collision. The plaintiff was a Bahamian Corporation. Security was given by the defendants on 23 December 1988 and the ship was released from arrest on that day.
