Collision action - Writ issued three days out of time - Whether time limit should be extended

A collision occurred between the plaintiffs’ ship Docebarra and the defendants’ ship Zirje on 17 October 1986. Section 8 of the Maritime Conventions Act 1911 provided that any action had to be brought within two years from the date when the damage was caused, but that the court might extend the period to such extent and on such conditions as it thought fit.
