Shipowners’ privileged survey report remains privileged in second action brought by different Plaintiff

In the course of legal proceedings between cargo owners and shipowners, the cargo owners sought to inspect a report of a survey of the vessel carried out at Sibenik, Yugoslavia, in March 1981 in connection with a previous action brought by different cargo owners and arising out of a previous voyage.
