Naviera Multinacional Del Caribe S.A. v. Sparti Compania Naviera S.A. (The Transworld Sailor) - Q.B.D. (Com.Ct.) (Steyn J.) - 10 September 1985

Admission of liability - Whether binding

In July 1980 Sparti chartered the vessel Transworld Sailor to Naviera M for a time charter on the Baltime form. The vessel duly carried a cargo of coffee from Acujutla Tuca/La Union to New York in July and August 1980. After discharge, claims were presented in New York against the charterers for damage to the cargo. A dispute then arose between the charterers and the owners as to which party was liable under the charterparty.
