In July 1980 Sparti chartered the vessel
Transworld Sailor
to Naviera M for a time charter on the Baltime form. The vessel duly carried a cargo of coffee from Acujutla Tuca/La Union
to New York in July and August 1980. After discharge, claims were presented in New York against the charterers for damage
to the cargo. A dispute then arose between the charterers and the owners as to which party was liable under the charterparty.
