1. Introduction

Construction in Spain is conceived as much as a process as the result of the process. It is governed by the Construction Act 38/1999, of 5 November 1999 (Ley 38/1999, de Ordenación de la Edificación, LOE). This Act regulates the essential aspects of the construction process, in other words, the action and the result of building a permanent work.
