Conflict of judicial opinion as to whether plaintiffs entitled to amend pleadings to include claims for further instalments of hire

In The Border Zea [ LMLN 109 - 5 January 1984] Sheen J. allowed plaintiff shipowners to amend their statement of claim to add a claim for two further instalments of hire which had fallen due since the issue of the writ. At the time the writ was issued the plaintiffs had no cause of action vested in them in relation to those two instalments.
