The vessel
Sagona
was time-chartered to the Total Transport Corporation on the Beepeetime 2 form for a period of 38 months. Between 7 and 10
July 1978 Mediterranea Raffineria Siciliana Petrolis SpA (“the shippers”) shipped a cargo of 28,872 tonnes of gasoil at Milazzo
in Sicily. The master signed and issued to the shippers a bill of lading in three originals. The destination on the bill of
lading was Rotterdam and delivery was “to order”.
