Master fails to comply with traffic separation scheme - Whether honest belief that no infringement committed can amount to a defence under Merchant Shipping Act

On 8 April 1980 the respondent was the Master of the British registered vessel Nordic Clansman. The vessel was 138,701 tons gross weight and 1101 feet in length. She had sailed from Immingham and was bound for ports in the Gulf which involved taking passage through the Strait of Hormuz.
