The Antaios (No. 2) - Q.B.D. (Com.Ct.) (Staughton J.) - 19 November 1982

No leave to appeal from arbitrators’ decision that owners had failed to exercise their right of withdrawal within reasonable time

This was an application for leave to appeal under the Arbitration Act 1979. There had been three concurrent arbitrations involving shipowners, charterers, sub-charterers and sub-sub-charterers. The question in issue was whether owners were entitled to withdraw the vessel under clause 5 of the NYPE form after a breach of the charterparty.
