Collision action - Overtaking situation - Nature of duty on overtaken vessel

The collision occurred shortly after 22 00 on 8 January 1979 just south of Vancouver Wharves in the northern portion of the Narrows in Vancouver harbour between Brockton Point and the First Narrows Bridge. Stormcrest , a tug of some 59 gross tons and 45 feet long was proceeding westerly. Telendos , 9,046 gross tons and 565 feet long, was also proceeding westerly on an approximately parallel course, but her speed was about 1.5 knots faster than Stormcrest whom she was gradually overtaking.
