1979 Arbitration Act - Arbitrator’s finding that charterparty was frustrated on certain date - Whether Court should grant leave to appeal

The vessel Wenjiang , under time charter to the applicants, became trapped in the Shatt-Al-Arab waterway as a result of the Iraq/Iran war. The sole arbitrator found that the charterparty became frustrated on 24 November 1980. Charterers had contended that frustration had occurred at an earlier date and applied to Mr. Justice Goff seeking leave to appeal from the arbitrator’s decision.
