Failure to supply funds or provide guarantee for port charges

Charterers sought to avoid liability for dermurrage on the ground that owners had failed to put up funds or provide a guarantee for port charges etc. and that as a result the ship lost an opportunity to berth and was delayed 16 days. The charterers had appointed agents who requested funds which the owners considered excessive. The owners appointed protecting agents and gave them the funds they requested which were considerably less than the other agent required.
