An arbitration was held in London under UNCITRAL rules. The arbitration took place in private, and the award was published only to the parties. Following the arbitrator's award, applications were made to the High Court by Bankers Trust Company ("Bankers Trust") and International Industrial Bank under section 68 of the Arbitration Act 1996 for the remission and setting aside of the award for serious irregularity. The hearing was conducted "in private" under CPR 62.10(3)(b), no contrary application or order having been made under CPR 62.10(1).
