Speed and consumption - Charterers complaining that vessel used excessive quantities of fuel - Whether charterparty contained warranty relating to fuel consumption

The issue in this case was whether the charterparty contained a warranty about the fuel consumption of the vessel, the charterers complaining that in breach of warranty she consumed excessive quantities of fuel. The arbitrators upheld the charterers’ contention. The owners appealed to the High Court.
