Admiralty practice - Vessel arrested pursuant to cargo claim - Shipowners seeking reduction in amount of bank guarantee to be furnished to secure release of vessel - Dispute as to extent of cargo damage - Whether Admiralty Court entitled to have regard to shipowners’ survey evidence as to extent of cargo damage

The plaintiff claimed compensation for alleged damages amounting to Tk 10,91,41,259/= (Taka ten crore ninety-one lakhs forty-one thousand two hundred and fifty-nine) caused to the cargo of cement carried by the Chinese vessel You Bang . When the vessel was in Bangladesh the plaintiff applied to the court for the vessel to be arrested. The court ordered the arrest of the vessel, the release of which could be obtained upon furnishing of a bank guarantee for Tk 6,50,00,000/= (Taka six crore and fifty lakhs).
