Charterparty containing London arbitration clause - Charterers bringing cargo claim against shipowners in foreign jurisdiction - Whether shipowners entitled to indemnity for charterers’ breach of agreement to refer disputes to London arbitration

The vessel was chartered on the Gencon form for the carriage of a cargo of bulk sulphur. The owners claimed damages and/or an indemnity in respect of any liability they might sustain as a result of the charterers bringing legal proceedings in respect of an alleged cargo shortage in Argentina, including the costs of defending such proceedings, together with interest and costs.
