Admiralty practice - Priorities as between possessory lienholder, registered mortgagee and necessaries claimant

This was an application to determine the priorities to the proceeds of sale of the vessel Edmonton Queen , as between the plaintiff, who claimed priority based on a possessory lien, a mortgagee (“the mortgagee”), who held a registered marine mortgage, and J.C. Damar Developments Ltd (“Damar”), who supplied goods and services to the vessel, and who based its claim inter alia on a constructive possessory lien and an equitable lien.
