Barge sustaining damage as a result of alleged negligence and misrepresentations by tugowners and tug charterers - Whether attachment of tug and bunkers by barge owners should be confirmed

The applicant was the owner of a barge which had been grounded on the Cape Town coastline while being towed by a tug owned by the first respondent and chartered by the second respondent. The applicant sought confirmation of an order attaching the tug and bunkers aboard the tug in actions in personam which it intended instituting against the respondents for damages suffered as a result of the grounding.
