Ssangyong Australia Pty Ltd and Anr v The Owners of the “Looiersgracht” and five other vessels and Ors - Federal Ct (Trial Div) (John A Hargrave Prothonotary) - 19 October 1994
Arrest of vessel in relation to claims against alleged sisterships - Whether arrested vessel beneficially owned by the person who was the owner of the alleged sisterships
The plaintiff cargo interests arrested the vessel
Looiersgracht
in relation to alleged damage to cargo carried not only on the
Looiersgracht
but also on five alleged “sisterships”. The defendant shipowners accepted that there was a
prima facie
claim against the
Looiersgracht
for damage to cargo carried on board her. The issue was whether the security to be posted should include security for alleged
damage to cargo carried on the five other vessels.
