Time charter - Legitimacy of last voyage - Date on which legitimacy must be established - Whether repudiatory breach

The vessel Gregos was time-chartered under the NYPE form for a period of “about 50 to maximum 70 days”. Clause 11 provided that the charterers should furnish the Captain from time to time with all requisite instructions and sailing directions. Delivery took place on 8 January 1988. It was common ground that redelivery became due at the expiry of the 70 days period, on 18 March 1988, with no further tolerance or margin.
