The contract of carriage
2.1 Cargo claims typically arise under a contract of carriage, usually in the form of a bill of lading or a similar transport document. Carriers may, however, also be sued in tort or bailment, and these concepts are explored in Chapter 3. Cargo claims arising outside some form of contractual framework are infrequent.
