In Vranicki v Architects Registration Board [2007] EWHC 506 (Admin); [2007] All ER (D) 288 (Mar) Mr Justice Collins dismissed an appeal by an architect against a decision of the Professional Conduct Committee of the Architects’ Registration Board (hereafter ‘the PCC’) in which it decided that the architect had been guilty of unacceptable professional conduct and serious professional incompetence. Mr Justice Collins affirmed that the court will recognise the expertise of the PCC so that, in a case concerned with professional competence, the court will be reluctant to interfere with a finding made by the PCC. That said, the court will not ‘simply bow to the decision of the PCC’. It will review the decision but, in doing so, will allow to the PCC a (significant) margin of appreciation.
