REVIEW OF PART II OF THE HOUSING GRANTS, CONSTRUCTION AND REGENERATION ACT 1996

On 17 September 2004 Sir Michael Latham produced his review of the operation of Part II of the Housing Grants, Construction and Regeneration Act 1996 (hereafter ‘the 1996 Act’) for the Department of Trade and Industy. This report will form the foundation of a consultation document to be issued by the Department of Trade and Industry later in the year. The report covers two issues, namely the payment provisions of the Act and the adjudication provisions. Working groups reported on each topic and produced a number of recommendations for change in each area. There was greater consensus on the suggested changes to the adjudication provisions than in the case of the payment provisions. The following discussion is no more than a bare outline of the reports.
