NUISANCE AND HUMAN RIGHTS – THE HOUSE OF LORDS GRANTS LEAVE TO APPEAL

Marcic v Thames Water Utilities Ltd [2002] 1 WLR 2274

The House of Lords ([2002] 1 WLR 2274) has allowed the defendant’s petition for leave to appeal from the decision of the Court of Appeal ([2002] EWCA Civ 64, [2002] 2 WLR 932, discussed in our March 2002 issue, pp.1–6). The appeal will give the House of Lords the opportunity to consider the expansion of the tort of nuisance that has taken place in recent years and also the relationship between the tort of nuisance and human rights.
