MEASUREMENT OF DAMAGES IN CLAIMS AGAINST NEGLIGENT SURVEYORS

In another claim against an allegedly negligent surveyor, the Court of Appeal has held that where purchasers of a residential property had relied on an allegedly negligent survey, the correct basis for measuring the resultant damages was not the cost of the repairs which the purchasers undertook but the difference between the market value of the property at the date of purchase and its actual value: Smith v Peter North & Partners (2001) unreported, 8 October, CA.
