‘PAID’ MEANS WHAT IT SAYS

Ruggieri v Magnox Electric plc ((2000) unreported, 14 April, CA)

A contract term which obliges an employer to pay to his contractor sums which the contractor has ‘paid’ to a third party sub-contractor cannot be extended so as to entitle the contractor or his assignee to recover sums which are payable to the third party but which have not been paid.
